Terms of Service

These Terms govern access to Metrify, its membership services, websites, software, materials, and related support.

This document is a carefully prepared operational template for Metrify. It should be reviewed by qualified legal counsel before public launch, particularly for tax, consumer-protection, and jurisdiction-specific requirements.

1. Agreement to these Terms

By creating an account, purchasing a membership, accessing a product, or otherwise using Metrify, you agree to these Terms and the documents incorporated by reference, including the Privacy Policy, Refund Policy, and Risk Disclosure. If you do not agree, do not purchase or use the service.

2. Nature of the service

Metrify provides memberships for the tools listed in each package at checkout. Available packages may include ATLAS, LMA, MDA, MSRI, SGC, S/R Framework and FVI. Metrify is not a broker, exchange, bank, investment manager, fiduciary, or personalized financial adviser. Metrify does not hold customer funds for investment, execute trades, or guarantee any market outcome.

3. Eligibility and account accuracy

You must have legal capacity to enter into a binding agreement in your jurisdiction. You are responsible for providing accurate identity, contact, billing, and platform-account information and for keeping it current. You may not use false details, impersonate another person, or transfer access without written permission.

4. Membership access and license

While your membership remains active, Metrify grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the products included in your plan for your own lawful analysis. No ownership rights are transferred. Following payment confirmation, you must request access for your own TradingView username. Access is provisioned to one TradingView account for the full package; the member page shows when provisioning is complete.

You can correct your username before the first grant without using a change. Once access is granted, you can request up to two completed username changes through your member account. A request enters the processing queue immediately; during a switch, the previous account's access is removed before the new account is granted.

You may not resell, sublicense, share, copy, reverse engineer, extract, redistribute, publish, record for redistribution, or commercially exploit Metrify products or access credentials. You may not circumvent access controls or use automation to reproduce protected functionality.

5. Billing, renewal, and taxes

Memberships are billed in advance through the payment processor identified at checkout. Recurring plans renew automatically at the interval and price displayed during purchase unless cancelled before the next billing date. You authorize the processor to charge the selected payment method for recurring amounts, applicable taxes, and disclosed fees.

You are responsible for taxes, duties, card-conversion costs, or bank charges imposed in connection with your purchase unless the checkout states that a particular amount is collected and remitted by the payment processor.

6. Cancellation

You may cancel future renewal through the available billing controls or by contacting support. Unless otherwise stated, cancellation takes effect at the end of the already-paid billing term. Deleting an account or ceasing to use the service does not by itself cancel a subscription.

7. Refunds and disputes

Refunds are governed by the published Refund Policy and any non-waivable rights under applicable law. Before initiating a chargeback, you agree to contact support so that Metrify has a reasonable opportunity to investigate. Fraudulent or abusive disputes may result in immediate suspension while the matter is reviewed.

8. Acceptable use

You must not use Metrify to violate law, manipulate markets, infringe intellectual property, mislead others, facilitate fraud, distribute malware, interfere with service integrity, scrape protected content, or create a competing product through unauthorized extraction. Access may be restricted when reasonably necessary to protect customers, systems, rights, or compliance obligations.

9. Availability and changes

Metrify may update, improve, replace, suspend, or discontinue features when reasonably required for security, compliance, reliability, product development, or third-party platform changes. Continuous or error-free availability is not guaranteed. Material membership changes will be communicated where reasonably practicable.

10. Intellectual property

Metrify, its branding, software, visual systems, research structure, documentation, and original materials are protected by intellectual-property law. Feedback may be used to improve the service without compensation, provided it does not require disclosure of your confidential personal information.

11. Third-party services

The service may depend on third-party platforms, data sources, payment processors, hosting providers, or charting environments. Their availability, policies, and technical operation are outside Metrify’s complete control. Your use of those services may also be governed by their separate terms.

12. Disclaimers

To the maximum extent permitted by law, the service is provided on an “as is” and “as available” basis. Metrify disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted operation, and profitability. Nothing in these Terms excludes rights that cannot legally be excluded.

13. Limitation of liability

To the maximum extent permitted by law, Metrify will not be liable for trading losses, lost profits, lost opportunities, indirect damages, consequential damages, data loss, interruption, or reliance on market information. Where liability cannot be excluded, aggregate liability will not exceed the amount you paid to Metrify during the three months preceding the event giving rise to the claim, unless applicable law requires a higher amount.

14. Suspension and termination

Metrify may suspend or terminate access for material breach, fraud risk, payment failure, abuse, intellectual-property violation, security risk, or legal requirement. On termination, your license ends immediately, although provisions intended to survive—such as intellectual property, disclaimers, liability limits, and dispute terms—remain effective.

15. Governing framework

These Terms are intended to be governed by the laws of the Republic of Indonesia, without regard to conflict-of-law rules, subject to mandatory consumer rights that apply in your country. The final dispute venue and any arbitration mechanism should be confirmed by legal counsel before launch.
